Personal injury claims may arise in different circumstances and may be recovered under different insurance risks (vehicle insurance, commercial insurance, employer insurance etc.).

Poland, as an EU-member implements EU regulations regarding to jurisdiction and law applicable to of tort claims and obligations of insurance contracts.

On grounds of Rome II Regulation, you are entitled to recourse, if the law of Your county gives you the right to recourse.

If damage arises in Poland, or Polish entity is a party to the contract, Polish law may be applicable to your case.

If you have paid compensation as insurer, on grounds of property or liability insurance, you may be entitled to recourse from the offender.

Under EU Regulation no 1215/2012, an insurer may bring proceedings only in the courts of the Member State in which the defendant is domiciled, irrespective of whether he is the policyholder, the insured or a beneficiary.
